Government Sues to Build Fence (Updated)

(Updated) Apparently, justice moved swiftly in this case, and the courts ordered Eagle Pass to open its land to the feds.At least the Bush Administration hasn’t completely abandoned the border fence. DHS has sued a Texas town, in order to force it to allow federal officials to survey public land owned by the city.

A federal judge has ordered a small border city in Texas to temporarily turn over its land to the federal government so it can begin to build a border fence.

U.S. District Judge Alia Moses Ludlum ordered the city of Eagle Pass, on the border about 100 miles southwest of San Antonio, to “surrender” 233 acres of city-owned land. The Justice Department sued the city for access to the land. Read more…

On a related note, the Arizona Daily News notes that the DHS has sued over 100 land owners along the Mexican border in order to gain access to the properties.

The U.S. Department of Justice has sued at least nine Arizona landowners, seeking temporary condemnations so it can survey and prepare to build a border fence.

The suits, filed in U.S. District Court in Tucson, seek to invoke the government’s power of eminent domain to gain access to land along the U.S.-Mexico border.

The actions come less than a week after the government said it was preparing to go to court to force dozens of property owners in the southwestern U.S. to allow them access. It said it was preparing to sue 11 landowners in Arizona, 71 in Texas and 20 in California. Read more….

Actually, this is good news and I’ll leave you with a comment posted at the Arizona Daily News site:

How about building the fence just NORTH of the uncooperative landowners property? That way then they can be unofficially a part of Mexico.

(Original post) As you read this article, the mayor of Eagle Pass, suggests that a fence would disrupt the “binational way of life” along the border. That’s the point, you jackass. Illegal immigration destroys the sovereignty of the United States and in case you don’t get it, that IS a bad thing.

We don’t want a watered down national, or “binational” identity, we want to keep our American identity.

Eagle Pass Mayor Chad Foster serves as chairman of the Texas Border Coalition, a group of border mayors, business officials and residents.

“We ain’t rolling over,” Foster said after learning of the lawsuit.

The Homeland Security Department is trying to build 370 miles of border fence by the end of the year. A 2006 law signed by President Bush and supported by both of Texas’ U.S. senators mandated a total of 700 miles of fence along the border.

Coalition members allege that the agency has failed to sufficiently consider concerns about effects on the environment, residents’ property and the binational way of life along the border and has ignored suggestions for alternatives. Read more….
